Boyd Graves asks NCI return 'missing' AIDS reports to national archives

Dear NCI FOIA OFFICE:


Recently the federal court ruled the prior Freedom of Information Act lawsuit should be dismissed because of a ‘service technicality’. At issue in the lawsuit was the failure of the National Cancer Institute to provide documents, two progress reports of the U.S. Special Virus program, progress reports #’s 14 and 15. Which represent the years 1977 and 1978, the end years of a secret federal virus development program that spent $550 million dollars to make a ‘special’ virus.

There is significant correspondence between Dr. Alan Rabson and myself as to these specific reports. On or about May 20, 2000, Dr. Victoria Cargill located the 1971 flowchart of the secret program. She also located in the NCI archives, three of the fifteen progress reports, #8, 14 &15.

Dr. Cargill turned the info over to Dr. Rabson, because the documents were located in the NCI archives. Dr. Rabson subsequently removed the two end progress reports and their whereabouts is currently unknown.

Under the Freedom of Information Act, we hereby request that progress reports #14 and 15 be made available and replaced in the archives where they were previously, and that the agency and Dr. Rabson be enjoined to ensure the documents are replaced.
